Terms and Conditions
1. About ArkPixels and the Service Owner
ArkPixels is a personal video game library service available through its official Android app, web account area, and related API services. These Terms govern access to and use of ArkPixels. The service is operated by Paolo Heesacker, Via Luigi Poletti 14, Olbia, Italy. Support is available at [email protected] and privacy requests at [email protected].
2. Eligibility
ArkPixels is reserved for adults aged 18 or over. By creating or using an account, you confirm that you are at least 18 and have legal capacity to accept these Terms. ArkPixels does not request your date of birth and does not use a separate age checkbox; you must not create or use an account if you are under 18.
3. Account Registration and Security
ArkPixels accounts are personal, non-transferable, and intended only for personal, non-commercial use through official ArkPixels clients. You must provide accurate information, keep your password confidential, never share credentials, and promptly report suspected compromise. Family is the name of a plan, not a shared account: a Family plan may include any trusted adults, whether or not related or living together, for up to six distinct personal accounts. Each member must use separate credentials.
4. User Content and Private Library Data
You retain ownership and other rights in profile details, images, notes, private library data, and other content you submit. You grant ArkPixels only the limited, worldwide, non-exclusive licence needed to store, process, synchronize, protect, back up, display to you, transmit on your instructions, and export that content while providing the service. ArkPixels does not acquire ownership of your content. You remain responsible for having the rights and permissions needed for anything you submit.
5. Acceptable Use
You must not use ArkPixels for illegal activity, fraud, infringement of intellectual-property or privacy rights, hate or harassment, sexually abusive or exploitative material, malware, impersonation, or unauthorized personal data about others. You must not resell the service, scrape it, use bots or unofficial clients, bypass authentication or limits, interfere with users or systems, or impose abnormal load. Good-faith security research is permitted only on your own account, with private reporting to [email protected], and without accessing another person’s data, establishing persistence, causing damage, creating abnormal load, exploiting beyond what is needed to verify the issue, or disclosing the issue before ArkPixels has had a reasonable opportunity to address it.
6. Third-Party Services, Game Metadata, Analytics, Ads, and Diagnostics
ArkPixels uses third-party services including Google Play, Google Drive, Firebase, AdMob, Valve/Steam, and Twitch/IGDB. Their availability, data, and separate terms may affect some features. Purchases and renewals are processed through Google Play, but ArkPixels remains responsible for providing and supporting the ArkPixels service and for all rights that cannot legally be excluded. Third-party metadata may be incomplete, delayed, inaccurate, or unavailable. Optional analytics and advertising choices are described in the Privacy Policy.
7. Intellectual Property
ArkPixels code, interface, branding, and service materials are protected by applicable intellectual-property laws and belong to ArkPixels or their respective licensors. The limited content licence in section 4 does not permit ArkPixels to sell your content or use it for unrelated advertising. Third-party names, game metadata, images, logos, and service marks remain the property of their respective owners.
8. Plans, Subscriptions, Billing, and Cancellation
Free includes the personal library, core metadata and statistics, one Steam profile, and manual Google Drive backup and restore, and may show ads. Plus removes ads and adds automatic Drive backup and one automatically synchronized Steam profile. Pro adds the published Pro tools, including advanced scanning, importing, bulk actions, and expanded Steam synchronization. Pro and Family may configure up to five Steam profiles, with no more than two synchronizations running at the same time. Family provides the published paid benefits to up to six distinct adult accounts. Current features, price, currency, billing period, renewal date, taxes, and any offer are shown before purchase. Google Play processes purchases, renewals, payment methods, cancellation, and eligible refunds. You can cancel at any time using the direct Google Play subscription-management link in ArkPixels; cancellation normally takes effect at the end of the paid period. Deleting an ArkPixels account does not cancel a Play subscription. ArkPixels will not materially reduce paid benefits during a period already paid for. Material future changes will receive reasonable advance notice, simple cancellation, and any remedy required by law.
9. Service Availability and Changes
ArkPixels may improve, replace, or discontinue features for product, maintenance, security, legal, or provider reasons. ArkPixels will give reasonable advance notice where a change materially affects the service or a paid plan, unless urgent security, legal, or operational circumstances make advance notice impracticable. Temporary interruptions may occur, but ArkPixels will use reasonable care and skill in providing the service and will not limit mandatory remedies available to consumers.
10. Account Export, Deletion, Suspension, and Termination
You may export your data, delete your account, or stop using ArkPixels at any time. For an ordinary violation, ArkPixels will normally explain the issue and allow at least 14 days to correct it before suspension or termination. ArkPixels may act immediately where reasonably necessary for fraud, illegality, security, serious harm, or material risk. A suspension notice will state a user-facing reason and provide a way to appeal at [email protected]; a suspended user may still request export or deletion through the limited recovery flow. Accounts inactive for 48 months may be deleted after notices 90, 30, and 7 days before the scheduled date. The inactivity process does not apply while an account has an active paid subscription or active Family benefit, and logging in cancels it. Some minimized legal, billing, security, and acceptance records may be retained as described in the Privacy Policy.
11. Disclaimers
ArkPixels does not promise uninterrupted availability or that third-party game metadata will always be accurate, complete, or current. Nothing in these Terms excludes the duty to provide digital services with the conformity, care, and remedies required by applicable consumer law. Security measures reduce risk but no online service can guarantee protection against every threat.
12. Limitation of Liability and Consumer Rights
ArkPixels is responsible for loss that is a foreseeable result of its breach of these Terms or failure to use reasonable care and skill. ArkPixels is not responsible for loss caused solely by the user, an unavoidable event outside reasonable control, or an independent third-party service where ArkPixels used reasonable care. Nothing excludes or limits liability for fraud, wilful misconduct, gross negligence, death or personal injury where exclusion is unlawful, or any mandatory consumer right or remedy.
13. Governing Law and Disputes
These Terms are governed by Italian law. If you are a consumer, this choice does not deprive you of mandatory protections available in your country of habitual residence, and you may bring a claim before any court that has jurisdiction under applicable consumer rules. Contacting [email protected] first may help resolve a dispute, but it is not a mandatory barrier to exercising legal rights or contacting a competent authority.
14. Changes to These Terms
ArkPixels may update these Terms when the service or law changes. The new version and effective date will be published, and reasonable advance notice will be given for material changes unless urgent circumstances require faster action. Existing users must accept materially updated Terms and acknowledge the updated Privacy Policy before continuing to use account features. Changes will not retroactively reduce rights for a period already paid for.
